INTRODUCTION

The Court must determine whether the administrative agency remains an indispensable party upon appeal of the agency decision. The Court had adopted a uniform practice of requiring participation of the agency pursuant to applicable procedural rule. The Court further recognized constitutional reasons for agency inclusion, but these concerns have dissipated over time. After careful and exhaustive consideration, the Court decides to permit agency intervention upon appeal, but shall no longer…
