There is but one ' question presented by this case for our determination. The plaintiff in error, Kidd, brought his action in the district court of Canadian county against the defendant in error, Seifert, to recover damages for property destroyed by fire which it was alleged was negligently set out by Seifert. This action is one for damages sounding in tort. An order of attachment was procured to issue upon the ground that the defendant was a non-resident of the territory.
