The plaintiff, a resident of Syracuse, and the defendant, a resident of the state of Georgia, by contract, on the 1st day of May, 1892, agreed to exchange lands; that of ■ the plaintiff being situated in the state of Georgia, and that of the defendant being situated in the city of Syracuse. The contract on the part of the defendant was executed by his agent, Edwin _E. Blake, under a power of attorney, the empoweringclauseof which reads as follows:

“I do make Edwin E. Blake my attorney to sign, seal, _ and deliver and fully execute articles of agreement unto Rose Grillenberger for a sale and…
