It is the duty of an executor or administrator in settling an estate not represented insolvent, to examine all *453claims against the estate, and pay such of them as are found to be valid; and to disallow such as are not found to be so, and give due notice of such disallowance to the person presenting the claim, in order that he may have an opportunity to test the same in the manner provided by law.
