MEMORANDUM OPINION AND ORDER
GOODWIN, District Judge.
Pending before the Court is the motion of the defendant San Con, Inc. (San Con) to disqualify Daniel A. Ruley, Jr. and the law firm of Steptoe & Johnson as counsel for the plaintiffs Roberts & Schaefer Company (Roberts & Schaefer) and Mingo Logan Coal Company (Mingo Logan). The Court finds that Mr. Ruley’s continued representation of the plaintiffs presents a conflict of interest. The Court therefore concludes that absent a waiver of the conflict of interest by San Con, Mr. Ruley and Steptoe & Johnson are disqualified from continuing to…
