Plaintiff is in possession of certain premises at Coney Island, situated upon the ocean front, upon which he has erected valuable buildings. Defendants claim that such buildings are within the .lines of a street known as West Twenty-third street, which had . been legally opened from -Surf avenue to the high-water mark on the shore of the Atlantic ocean, and attempted to remove them.
