The amended information in this case, upon which the defendant was tried, contains two counts. In the first, he was charged with murder in the first degree; in the second, with robbery. The trial resulted in a verdict finding the defendant guilty of murder in the second degree and acquitting him of the charge of robbery. Motions in arrest of judgment and for a new trial were made, both of which were overruled, and from the judgment and sentence the defendant appeals.
