Affirming in part and reversing in part.
In the early part of 1920, the appellant and the appellee entered into a partnership, the terms of which, except as to one point, are not in dispute. Each was to contribute to the partnership funds the sum of $1,500.00. With the $3,000.00 thus realized they were to buy from the Yellow Poplar Lumber Company all the sunken logs owned by it in the Big Sandy river and its tributaries from Catlettsburg, Kentucky, to the headwaters of that river and its tributaries. The logs thus bought were to be sawed into crossties…
