This appeal is from the refusal to take off a non-suit. The action was in assumpsit to recover $1386 on the following writings, the first being part of ex- Mbit B to tbe statement of claim, and tbe second, a receipt, which was exhibit C to the statement:

“Whereas, Domenick Iero, as owner, has entered into a contract dated March 12, 1927, with......the Reliable Cornice and Roofing Works, contractor, for the roofing-work for an operation of forty-three (43) houses situate on......Smylie Road......in...... PhiladelpMa, for a cash consideration of $3,989, payable as the work…
