The defendant in error, Adah B. Walton, administratrix of the estate of her deceased husband, James R. Walton, brought her suit in the circuit court of Macon county against the plaintiffs in error, receivers of the Wabash Railroad Company, to recover damages for his death, alleged to have been due to the negligence of the plaintiffs in error while he was in their employ as a brakeman on a passenger train. After demurrers to the amended declaration and an additional count had been overruled the defendants filed pleas, and there was a trial by jury resulting in a verdict of $17,000 apportioned…
