On the 11th day of April, 1887, Stephen J. Smith filed his hill in the Circuit Court of Doddridge county, in which he alleged in substance that being the owner of a tract of land sitúated in said county containing one hundred and sixty seven acres, and being indebted to his brother Vincent Smith in the sum of two hundred and eighty one dollars, he executed a deed of trust upon said tract of land to C.
