This is an appeal from a decision of the Environmental Appeals Board [Board] by T.V. Spano Building Corporation [TVSBC] and cross-appeal by John E. Wilson, Secretary of Delaware Department of Natural Resources & Environmental Control [DNREC]. 1 Jurisdiction of the Court to address this appeal is exercised pursuant to 7 DelC. §§ 6009, 6313 and 29 Del.C. § 10161(9).
