MEMORANDUM ON TRUSTEE’S OBJECTION TO CLAIM OF EXEMPTION

This contested matter is before the court upon the Objection to Debtor’s Claim of Exemption (Objection to Exemption) filed by Ann Mostoller, Chapter 7 Trustee, on July 8, 2008, objecting to the Debtor Thomas E. Vickers’ claimed exemption in an annuity under Tennessee Code Annotated § 26 — 2—111(1)(D) (Supp.2008). A hearing was held on August 7, 2008, and the matter set for trial on November 5, 2008.
