THACHER, District Judge.

The relat- or, au alien resident of the United States, was excluded from entry when returning from a temporary visit abroad. He was first lawfully admitted to the United States in March, 1907, and since that date has made temporary visits to Italy, including an absence from May, 1915, to November, 1919, during which period be served as a reservist in the Italian army.
