GILL, Chief Justice.
F. M. Fitzgerald sued W. M. Goodson in trespass to try title to recover a tract of about 800 acres of land lying to the north of and adjoining the Griffith league survey in Liberty County. The land was claimed by plaintiff as a part of the Welch league of which he was the owner. It was held by Goodson on the theory that it was vacant school land which he had purchased from the State. The case turned upon the inquiry whether there was a vacancy between the Welch and the Griffith.
