Plaintiff’s petition alleges that he was a former owner of an undivided one-half interest in certain described city lots; that on January 17, 1940, he executed a quitclaim deed to said lots to defendants under an oral agreement that defendants would sell the lots and deliver to plaintiff one-half of the sale price less necessary expenses; that defendants made a sale of the lots on March 24, 1941, and received the sum of $1,650 therefor, and have since been indebted to plaintiff in an amount equal to one-half of the net proceeds from the sale.
