This is an- action in the nature of a quo warranto, brought in the name of the attorney general, to oust the defendant from the office of trustee of the Second ward of the village of Oneonta, in the county of Otsego, and to adjudge the relator, Albert Shafer, entitled thereto, upon the ground that the defendant has *607wrongfully entered into and unlawfully withholds the said office from the relator.
