Appeal by defendant from an order dispossessing him as tenant of certain premises in the city of Utica, N. Y., in summary proceedings, after trial by a jury, in Justice’s Court of the city of Utica.

Defendant was a tenant under a lease of the premises in question, executed by one I. A. Williams, the term of which expired March 31, 1913. On the 1st day of February, 1909, and after the date of said lease, and while defendant was in possession of the premises in question thereunder, Williams gave what has been called a “trust deed,” conveying a number of parcels of real estate, including that leased to the defendant, to his son, Aras J.
