The People appeal from an order of the Town of East Rochester Justice Court (41 Misc 3d 185 [2013, Brown-Steiner, J.]) granting defendant’s motion to vacate a judgment of conviction entered against him February 11, 2013, following defendant’s guilty plea to one count of driving while intoxicated (Vehicle and Traffic Law § 1192 [3]). The plea also satisfied transactional charges under Vehicle and Traffic Law §§ 1128, 1163, and 1194.
