OPINION

SHEA, Justice.

This case is before us on appeal by the defendant following his conviction of entering a building with intent to commit rob bery and conspiracy to commit robbery. We sustain defendant’s appeal, vacate the judgment of conviction, and remand the ease for a new trial. The facts of the case insofar as pertinent to this appeal are as follows.
