ENOCH, Circuit Judge.

Under authority of the Federal Declaratory Judgment Act, Title 28 U.S.C.A. § 2201, plaintiff herein, Tony Williams, filed complaint for declaratory judgment in the District Court. Mr. Williams* complaint alleges that, as members of a singing quintet known as “The Platters”, he and the other four members of the-singing group, entered into a contract, with defendant, Mercury Record Corporation (hereinafter called “Mercury”) on or about February 19, 1959.
