This case requires us to determine (1) whether, when an employer seeks to benefit from the exception described in Greenway v. Buffalo Hilton Hotel, 143 F.3d 47 (2d Cir.1998), the burden is on the employer to establish that a Title VII plaintiff made no reasonable effort to find compara ble employment and (2) whether, when the defendant fails to object to jury consideration of lost wages under Title VII, the issue may be submitted to the jury for a non-advisory jury determination.
