Tins is an application for the laying out of a highway. A committee appointed by the court reported that they found the way to be of public convenience and necessity and that they had surveyed and laid it out. The town of East Haddam, the defendant in the case, and Henry F. Gardner, a land owner on the proposed route, severally remonstrated against the acceptance of the report. The court found the facts on the remonstrances, overruled them, and passed a decree establishing the highway. The remonstrants severally appealed to this court.
