This is an appeal from a decision of the district court concerning the validity and effect of the City of Lewiston’s annexation and zoning of previously unincorporated lands owned by the defendants, Robert and Elizabeth Bergamo. Specifically, the Bergamos challenge a decision of the district court upholding the validity of the ordinance by which the City annexed their property. The Bergamos also argue that the district court erred in concluding that a municipality is not a “person” for purposes of 42 U.S.C. § 1983 and dismissing their claim for damages under that…
