MEMORANDUM OPINION

ELLIS, District Judge.

Petitioner Anthony Gaskins, a Virginia inmate proceeding pro se, filed this petition for writ of habeas corpus, pursuant to 28 U.S.C. § 2254, challenging the denial of good conduct credits. Respondent, Gene M. Johnson, the Director of the Virginia Department of Corrections, filed a Motion to Dismiss and Rule 5 Answer on December 28, 2005. Gaskins was given the opportunity to file responsive materials, pursuant to Roseboro v.
