hOn May 2, 2000, plaintiff, Argonaut Great Central Insurance Company (“Argonaut”), instituted this legal malpractice action naming attorney W. David Hammett, and the law firm of Davenport, Files and Kelly, L.L.P. (“Hammett/Davenport”), as defendants. The alleged malpractice concerns Hammett/Davenport’s failure to timely file Argonaut’s third party claim(s) for negligence and indemnity against Argonaut’s broker/agent Powell Insurance Company (“Powell”).
