Smith, J.:

This is an action in mandamus to compel defendants to reinstate plaintiff as lieutenant in the fire department of the city of Wichita and to compensate him for damages by reason of his dismissal. Judgment was for defendants. Plaintiff has appealed.

After the formal allegations, the motion for a writ alleged that plaintiff had since June 2, 1935, been a full time member of the fire department of Wichita and was at the time the action was begun a lieutenant; that the city had a full time paid fire department; that the city was required by G.
