Order unanimously modified on the law and as modified affirmed without costs, in accordance with the following memorandum: Carolyn Derso died from injuries sustained on November 25, 1983, when the vehicle operated by defendant Hughes allegedly crossed the center line of the highway and struck head on the Volkswagen Rabbit being operated by Derso. In the subject action, plaintiff seeks damages from Volkswagen of America, Inc. (VWOA) and Volkswagenwerk, AG.
