The defendant, Charles D. Yale, appeals from a judgment of conviction rendered in Erie County Court following his plea to a reduced charge of attempted burglary in the third degree and attempted criminal possession of stolen property (both E felonies). Since the defendant had a previous felony conviction, he was sentenced to concurrent terms of not less than one and one-half nor more than three years as a second felony offender (Penal Law, § 70.06, subd 3, par [d]; subd 4).
