This suit originated in the Circuit Court of Tate County, Mississippi. Appellants brought suit against appellee for damages caused by fire to young timber on their lands, alleged to have been started or set out by appellee and carelessly permitted to spread to their lands. When plaintiffs had concluded the introduction of their testimony and proof to sustain the charge of negligence against defendant, he moved the court to grant a peremptory instruction to the jury in favor of defendant based upon the ground that the evidence offered was insufficient to sustain the charge of negligence set…
