It appears from the record in this case that the plaintiff instituted his suit against the defendant in Eichmond superior court on a demand originating prior to 1st of June, 1865, The petition was filed and the process attached and dated 31st December, 1869. The sheriff made his return thereon, dated 28th of May, 1870, that the defendant was not to be found. No action appears to have been taken in the case at the appearance term.
