Respondent, in support of a petition for rehearing, has submitted a spirited brief in which he contends that our construction of the real estate brokers act (CR 423, Laws 1929; Ch. VTI, Title LNIII, Oregon Code 1930) fails to give any effect to section 30, which provides that no person shall maintain an action for collection of compensation as a real estate broker without alleging and proving that he was duly licensed at the time the alleged cause of action arose.
