KENNEDY, District Judge.
Plaintiff in error, plaintiff in the court below, brought this suit in his capacity as administrator of the estate of Orville J. Kerr, deceased, to recover damages for the death of said Kerr, alleged to have occurred on or about the 30th day of August, 1920, by the negligence of the defendant. At the close of all the evidence in the case, a motion for a directed verdict was made on behalf of the defendant, such motion sustained, and a judgment entered upon the verdict in favor of the defendant and against the plaintiff for costs.
