BREWSTER, District Judge.
This action is for a declaratory judgment. The issues are (1) whether Claim 15 of Doble Patent, U. S. No. 1,945,263, is valid and, if valid, (2) whether plaintiff infringes. A master found the claim valid but that plaintiff did not infringe. The defendant excepted to the master’s ruling respecting infringement. The matter came before the court on defendant’s exception and, after consideration, an opinion was rendered in which the master’s findings of fact were adopted and his rulings affirmed.
