The plaintiff in error was the defendant, and the defendant in error the plaintiff, in the District Court. They will be referred to as they appeared in that court, namely, as plaintiff and defendant respectively.
The plaintiff brought this action in 1920 for damages for the breach of a contract for the sale of certain property. The damages claimed were the difference between the agreed and tbe market price.
