Action in Case, for killing domestic animals. Appeal from the Circuit Court of Wayne County; the Hon. Enoch E. Newlin, Judge, presiding. Heard in this court at the August term, 1899.

This was a suit, commenced before a justice of the peace in Wayne county, hy appellee against appellant, to recover for loss of a colt, killed on appellant’s railroad by an engine and cars operated thereon, by appellant. After judgment in the justice’s court, the case was appealed to the Circuit Court, where trial was had by jury,' resulting in a verdict and judgment in favor of appellee.
