Defendant, Barbara Ann Davis, was charged with the murder of Marvin Adams. After a bench trial, she was found guilty of voluntary manslaughter and sentenced to a term of 3 to 9 years. On appeal, defendant contends that she was not proved guilty beyond a reasonable doubt; tiiat a new trial should have been granted on the ground of newly discovered evidence; and that the sentence was excessive.

Defendant had been living with the decedent and had three children by him. The shooting occurred on July 22, 1972, in a gangway south of the premises at 7224 South Emerald in Chicago.
