The petitioner in this CPLR article 78 proceeding is a New York City fireman who seeks an order: (1) vacating his failing score on a promotional examination for the position of lieutenant, (2) directing the respondents to accord him a passing score, and (3) annulling the respondents’ determination which denied his claim for veteran’s preference.
