This is a case stated growing out of the exercise by a housing authority of its right of eminent domain. The condemnation was of a tract of unimproved land over which a telephone company had been granted a right-of-way subject to a stipulation that if its lines as originally located should interfere with the construction of improve*326ments on the land the necessary changes to avoid such interference would be made by and at the expense of the telephone company, and the question involved is whether, after accepting from the housing authority the grant of a new right-of-way as of equal…
