Reversing.

The appellant as plaintiff below filed this suit in tbe Knott Circuit Court against tbe appellee as defendant below, alleging that be was tbe owner and in possession of 25 acres of land in that county, and that tbe defendant bad entered upon it and bad marked a number of trees and was giving it out and claiming that be was tbe owner of tbe land, and plaintiff asked that bis title thereto be quieted.
