This proceeding arises from an inter-pleader action, initiated by Wilson, Dillon, Pumroy, & James, L.L.C. (“the escrow agent”), in the Calhoun Circuit Court. Larry Ginsburg and Leonard Goldschein entered into a purchase and sale agreement (“the purchase agreement”) with Mountain Pointe Development Group, L.L.C. (“Mountain Pointe”), regarding the purchase of certain real estate. Pursuant to the purchase agreement, Ginsburg and Goldschein deposited $25,000 of earnest money with the escrow agent.
