This case ivas here at a former term, (52 Ill. App. 86,) and was then reversed for reasons stated, which applied specially to Samuel Chipman, one of the appellants at that time.

Having been remanded, the case was tried again. The item of the draft was eliminated and the contention related solely to the certificate of deposit.

During the trial the plaintiffs dismissed as to defendant Chipman. The issues were found for the plaintiffs, damages assessed at the amount of the certificate of deposit and interest, but pending a motion for new trial the plaintiffs remitted $1,296.44, the amount…
