OPINION
JO ANN C. STEVENSON, Bankruptcy Judge.
This matter comes to the court on motion for partial summary judgment filed by the Debtor Shoreham Paper Company, f/k/a Watervliet Paper Company, Inc. (“Water-vliet” or “Debtor”). 1 Defendant Berrien County (“County”) and the City of Water-vliet (“City”) have filed answers and briefs in support. 2 Watervliet, the County and the City all agree that there is no genuine issue as to any material fact and that the question presented is one of law.
