State v. Hittle
Court of Appeals of Utah
1Opinion of the Court
OPINION
GREENWOOD, Judge.
¶ 1 Defendant David Hittle appeals his conviction and the trial court's denial of his motion to withdraw his guilty plea because the trial court failed to advise Defendant of his right to a speedy trial under Rule 11(e)(3) of the Utah Rules of Criminal Procedure. 1 While conceding that the trial court failed to advise Defendant of his right to a speedy trial under rule 11(e)(8), the State argues that the error was harmless because Defendant has failed to show that but for the trial court's omission, he would have proceeded to trial. We reverse.
