Appeal from an order of the Supreme Court (Dawson, J.), entered July 16, 2002 in Clinton County, which denied plaintiffs motion to set aside a verdict in favor of defendant North End Repair, Inc.

Plaintiff sued for injuries to his neck, back and left shoulder that he allegedly suffered when one of the legs on a stepladder collapsed and he fell approximately five feet to a concrete floor.
