HARPER, Judge.

Appellant was indicted, charged with the ' of fense of assault to rape upon his stepdaughter, on or about August 9, 1909; when tried, he was convicted and his punishment assessed at fifteen years in the penitentiary.

Appellant complains of the action of the court in overruling his application for a continuance. In view of the disposition we will make of this case, it is not necessary to pass on this question.
