This is a contest for tbe office of dative testamentary •executor of the last will of Milton Taylor, deceased.

On the thirtieth March, J870, John J. Rickey applied for tbe appointment of dative testamentary executor, alleging in bis petition that Milton Taylor, late of Kentucky, died in Cincinnati, Ohio, leaving bis will, which was probated on tbe twenty-sixth November, 1869, in the probate court of tbe county of Hamilton, State of Ohio, and tbat be was there appointed dative testamentary executor, tbe executor named in the will having declined to act.
