In 2011, three surviving spouses of deceased individuals who had entered into Home Equity Converse Mortgages (“HECMs”) sued the Secretary of the Department of Housing and Urban Development (“HUD”) in his official capacity, alleging that regulations implementing the federal HECM insurance program violated the Administrative Procedure Act (“APA”), 5 U.S.C. §§ 551, et seq.
