The plaintiff in error was indicted for the murder of Vina Coleman on April 14, 1899, in the Indian Territory. He is an Indian of the Choctaw tribe of Indians, and after having pleaded not guilty to the indictment the venue was changed upon motion, and the cause was sent for trial to the United States Dis- ' trict Court holden at Paris in the Eastern District of Texas. Upon the trial before that court the defendant set up the de-fence of insanity, the jury found him guilty of murder as charged in the indictment, and he was sentenced to suffer the penalty of death.
