Appeal from an order of the Supreme Court (Hughes, J.), entered August 28, 1998 in Albany County, which, inter alia, denied defendants’ motion to compel plaintiff to comply with defendants’ discovery demands.
Plaintiff commenced this action alleging that it was induced *577by defendants’ fraudulent and negligent misrepresentations to invest $105,000 in a mutual fund ill-suited to the investment objectives which Briand Parenteau, plaintiffs president, had previously communicated to defendants.
